Submitting our opt-in form is a request to be contacted about our services. It is not an offer, contract, or guarantee of services. We reserve the right to decline to work with anyone for any lawful reason. Any actual engagement to provide marketing services will be governed by a separate written agreement between you and Malley Marketing.
By providing your phone number and checking the SMS consent box on our opt-in form, you agree to these SMS Terms in addition to our general Terms of Service.
Program description: Malley Marketing operates two SMS programs. You may opt in to either or both:
Message frequency: Message frequency varies based on your interaction with us and which program(s) you opt in to.
Cost: Message and data rates may apply, depending on your mobile carrier and plan. Malley Marketing does not charge for the messages themselves.
How to opt out: You can opt out at any time by replying STOP to any message. You will receive a confirmation message and no further texts will be sent. If you opt out of one program (for example, marketing) but remain opted in to the other (transactional), only marketing messages will stop unless you opt out of both.

Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
Supported carriers: Major U.S. carriers including AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and others.
Eligibility: The SMS program is available to U.S. residents who are at least 18 years old.
Your use of the Site and our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Site, you consent to the practices described in the Privacy Policy.
All content on the Site — including text, graphics, logos, images, and the overall design — is owned by Malley Marketing LLC or used with permission, and is protected by U.S. and international copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from any content without our written permission.
The Site and Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Site or Services, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or harmful components.
Marketing results vary. We do not guarantee specific business outcomes such as a particular number of leads, sales, or follower growth. Past performance does not guarantee future results.
To the fullest extent permitted by law, Malley Marketing LLC, its members, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site will not exceed one hundred U.S. dollars ($100) or the amount you paid us in the six months prior to the claim, whichever is greater.
You agree to defend, indemnify, and hold harmless Malley Marketing LLC and its members, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Monroe County, New York, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. Continued use of the Site after changes are posted means you accept the updated Terms.
We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections of these Terms that by their nature should survive termination (such as Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
